The rules and regulations outlined in the “Community Center Information and Rules” were established to ensure the safety and enjoyment of all members and their guests. Due to the seriousness of the rules, Vista Ridge Master Homeowners Association, Inc., (the “Association”) does not tolerate rule violations and has established the following disciplinary policy to be used when the rules are violated.
1. Record-Keeping System. The Community Center Staff will be responsible for maintaining accurate and fair records of any and all offenses made by individuals utilizing the facilities.
2. Offenses. An offense will be committed upon violation of the Community Center Information and Rules, or upon the commitment of an act endangering the health, safety, and property of the Community Center. Warnings will be issued for each successive offense.
3. Warnings.
a. First Offense: Verbal. The offending individual will receive a verbal warning from a Community Center Staff Member that such behavior will not be tolerated. The Staff Member will make an accurate recording of the verbal warning.
b. Second Offense: Written\Meeting. The offending individual will receive a written warning that such behavior will not be tolerated and that continued behavior may lead to the individual’s exclusion from the facilities. Or the offending individual will be asked to attend a meeting with Community Center Staff Members to discuss his or her misbehavior. If the member chooses not to attend the meeting, the Association may, upon notice and hearing, suspend recreational privileges of the individual.
c. Third Offense: Suspension of Privileges. Upon notice and hearing, the Board of Directors of the Association may suspend privileges of the offending individual for a period to be defined by the Board.
4. Offenses by Minor Members. Offenses by minor members will be handled the same as those by adults except:
d. The verbal warning will be issued to the minor member at the time of the offense. If the minor member is unaccompanied by a parent or guardian, the parent or guardian will be contacted and informed of the offense. Should the minor member commit a second offense before the parent or guardian has been notified verbally, the Community Center Staff may still issue a written warning for the second offense.
e. The written warning will be sent to the adult in the household to which the membership is attached.
f. The Community Center Staff will hold a meeting with the parent or guardian and the minor member. The minor member will not be allowed re-entry to the Community Center until the meeting has taken place with all parties present.
5. Offenses by Guests. Members will be responsible for the actions of their guests. Any offenses committed by a guest will be treated as if committed by the accompanying member. If a guest commits an offense, the accompanying member will be subject to the warnings in Section 3 of this policy.
6. Violations or Offenses that Constitute a Present Danger. If, in its sole discretion, the Community Center Staff, lifeguard, or other employee, deems that any violation is or may be an immediate or substantial threat to the health, safety or welfare of the community or an individual, the Community Center Staff may impose any appropriate sanction as necessary to abate the threat to health, safety or welfare of the community or individual without prior compliance with Sections 3 above. |
