6-7-3: DOGS:

A. Licensing Requirements:

1. License Required: Any person harboring, owning, possessing or keeping any dog six (6) months of age or older within the town for any consecutive fourteen (14) day period, or longer, shall secure a license for such dog from the town clerk and pay the license fee therefor.

2. Tag And Collar: A metal tag shall be furnished as license identification with each license, bearing the number of the license, and the year of the issue of the same, which metal tag the owner shall have attached to the collar to be worn by the animal so licensed.

3. Expiration Of License: Each license shall expire on December 31 of the calendar year in which the license was issued.

4. Nontransferability Of License: Licenses and symbols of license identification under this subsection are not transferable.

5. Importation Period; Time Limit: Any dog brought into the town or adopted shall comply with this subsection within thirty (30) days of importation or adoption. (Ord. 608, 9-24-1998)

6. License Fee: The annual license fee shall be as provided in section 2-10-8 of this code. The fee shall apply for any full year or part thereof and shall not be refunded for any reason. (Ord. 608, 9-24-1998; amd. Ord. 726, 10-10-2000)

B. Rabies Vaccination Required: It is unlawful for any person to own, keep, harbor, or possess any dog over the age of six (6) months which has not been vaccinated against rabies. The owner of any dog shall have the animal vaccinated by a licensed veterinarian by six (6) months of age, and shall keep the vaccinations current. The vaccines used will be ones licensed by the U.S. department of agriculture and approved by the Colorado department of public health and environment and will provide for at least a one year duration of immunity.

C. Restraint And Control: Every person owning or having charge, care, custody or control of any dog of any age shall keep such dog exclusively upon his own premises; provided, that such dog may be off such premises if it is under the control of a competent person and restrained by a substantial chain or leash not exceeding six feet (6') in length. D. Prohibited Acts And Conditions:

1. Noise: It shall be unlawful for any owner or keeper of any dog to prevent the animal from disturbing any person by barking, howling, yelping, or any other audible sound. No summons shall be issued and no person shall be convicted at trial for violating this section unless a minimum of two (2) witnesses from separate households testify about the nature of the barking, howling, yelping, or other audible sound, unless there is other evidence corroborating the testimony of a single witness. A police officer or code enforcement officer may corroborate the elements of this subsection and may issue the summons and testify as a second witness. (2004 Code)

2. Damaging Property 68: It shall be unlawful for any owner, possessor, or person who keeps any dog to permit such dog to destroy or damage the real or personal property of any person, or any public property of the town. (Ord. 608, 9-24-1998)

6-7-8: ANIMAL EXCREMENT:

A. Actions Constituting Littering: It shall be unlawful for any owner, possessor, or person, who keeps any domestic animal, to permit any such domestic animal to deposit or leave any fecal matter on any public or private property of another, or in any waters. It shall be an affirmative defense to this subsection that in the event of the depositing of fecal matter by a domesticated animal, the animal is in the immediate control of a person, and such person forthwith removes such material from the said private or public place. B. Offensive Premises: The accumulation of animal feces compromises public health and constitutes a threat to public safety and welfare. It is unlawful for the owner or keeper of an animal to allow animal feces to accumulate so as to be a health hazard or so that the odor is noticeable on adjoining property. Such premises are declared to be a public nuisance. (Ord. 608, 9-24-1998; amd. 2004 Code)
